DEFINITIONS (Termes EASA)
On entend par (the following definitions shall apply::
1) «ballon», un aéronef non motorisé plus léger que l'air, avec équipage, et capable de voler grâce à l'utilisation soit d'un gaz plus léger que l'air, soit d'un brûleur embarqué, y compris les ballons à gaz, les ballons à air chaud, les ballons mixtes et, bien qu'ils soient motorisés, les dirigeables à air chaud;
(1) ‘balloon’ means a manned lighter-than-air aircraft which is not power-driven and sustains flight through the use of ither a lighter-than-air gas or an airborne heater, including gas balloons, hot-air balloons, mixed balloons and, although power-driven, hot-air airships; 2) «ballon à gaz», un ballon libre capable de voler grâce à un gaz plus léger que l'air; (2) ‘gas balloon’ means a free balloon that derives its lift from a lighter-than-air gas;
3) «ballon à gaz captif», un ballon à gaz muni d'un système d'ancrage continu à un point fixe pendant l'exploitation;
(3) ‘tethered gas balloon’ means a gas balloon with a tether system that continuously anchors the balloon to a fixed point during operation;
4) «ballon libre», un ballon qui n'est pas continuellement ancré à un point fixe au cours de l'exploitation;
4) ‘free balloon’ means a balloon that is not continuously anchored to a fixed point during operation;
5) «ballon à air chaud», un ballon libre capable de voler grâce à de l'air chauffé;
(5) ‘hot-air balloon’ means a free balloon that derives its lift from heated air;
6) «ballon mixte», un ballon libre capable de voler grâce à la combinaison d'air chauffé et de gaz ininflammable plus léger que l'air;
(6) ‘mixed balloon’ means a free balloon that derives its lift from a combination of heated air and a lighter-than–air, non-flammable gas;
7) «dirigeable à air chaud», un ballon à air chaud motorisé dont le moteur ne crée pas de poussée verticale;
(7) ‘hot-air airship’ means a power-driven hot-air balloon, whereby the engine does not create any portion of lift;
8) «vol de compétition», toute opération aérienne consistant à utiliser un ballon pour des courses ou des concours, ainsi que pour s'y exercer et pour rallier ou quitter un lieu de courses ou de concours;
(8) ‘competition flight’ means any air operation with a balloon performed for the purposes of participating in air races or contests, including practising for such an operation and flying to and from air races or contests;
9) «manifestation aérienne», toute opération aérienne effectuée avec un ballon et consistant à faire une démonstration ou donner un spectacle lors d'une manifestation ouverte au public, ainsi qu'à utiliser un ballon pour s'y exercer et pour rallier ou quitter le lieu de la manifestation;
(9) ‘flying display’ means any air operation with a balloon performed for the purposes of providing an exhibition or entertainment at an advertised event open to the public, including practising for such an operation and flying to and from the advertised event;
10) «vol de découverte», toute opération aérienne effectuée contre rémunération ou à tout autre titre onéreux, consistant en un voyage aérien de courte durée visant à attirer de nouveaux stagiaires ou de nouveaux membres et proposé par un organisme de formation agréé conformément au règlement (UE) no 1178/2011 de la Commission (2) ou un organisme créé afin de promouvoir l'aviation sportive et de loisir;
(10) ‘introductory flight’ means any air operation against remuneration or other valuable consideration consisting of an air tour of short duration for the purpose of attracting new trainees or new members, performed either by a training organisation approved in accordance with Commission Regulation (EU) No 1178/2011 (2) or by an organisation created with the aim of promoting aerial sport or leisure aviation;
11) «principal établissement», le siège social ou le siège principal de l'exploitant du ballon au sein duquel sont exercées les principales fonctions financières, ainsi que le contrôle opérationnel des activités visées par le présent règlement;
(11) ‘principal place of business’ means the head office or registered office of the operator of the balloon within which the principal financial functions and operational control of the activities referred to in this Regulation are exercised;
12) «contrat de location coque nue», un contrat conclu entre entreprises aux termes duquel le ballon est exploité sous la responsabilité du preneur.
(12) ‘dry lease agreement’ means an agreement between undertakings pursuant to which the balloon is operated under the responsibility of the lessee.
Pour les opérations Aériennes : (AnnexeII) on entend par :
1) «moyens acceptables de conformité (AMC)»: des normes non contraignantes adoptées par l'Agence pour illustrer des méthodes permettant d'établir la conformité avec le règlement (CE) no 216/2008 et ses modalités d'exécution;
1. ‘acceptable means of compliance (AMC)’ means non-binding standards adopted by the Agency to illustrate means to establish compliance with Regulation (EC) No 216/2008 and its implementing rules;
2) «moyens de conformité alternatifs (AltMOC)»: les moyens qui constituent une alternative à un AMC existant ou proposent une nouvelle méthode pour établir la conformité avec le règlement (CE) no 216/2008 et ses modalités d'exécution, pour laquelle aucun AMC associé n'a été adopté par l'Agence;
2. ‘alternative means of compliance (AltMoC)’ means those means that propose an alternative to an existing AMC or those that propose new means to establish compliance with Regulation (EC) No 216/2008 and its implementing rules for which no associated AMC have been adopted by the Agency;
3) «pilote commandant de bord»: (PIC) le pilote désigné pour le commandement et chargé de conduire le vol en toute sécurité;
3. ‘pilot-in-command’ means the pilot designated as being in command and charged with the safe conduct of the flight;
4) «membre d'équipage»: une personne qui se voit attribuer par un exploitant des tâches à exécuter à bord du ballon ou, dans la mesure où les tâches sont directement liées à l'exploitation du ballon, au sol;
4. ‘crew member’ means a person assigned by an operator to perform duties on board the balloon or, where the duties are directly related to the operation of the balloon, on the ground;
5) «membre d'équipage de conduite»: un membre d'équipage titulaire d'une licence, chargé d'exercer des fonctions essentielles à la conduite d'un aéronef pendant une période de service de vol;
5. ‘flight crew member’ means a licensed crew member charged with duties essential to the operation of an aircraft during a flight duty period;
6) «substances psychoactives»: l'alcool, les opioïdes, les cannabinoïdes, les sédatifs et les hypnotiques, la cocaïne, les autres psychostimulants, les hallucinogènes et les solvants volatils, à l'exclusion du café et du tabac;
6. ‘psychoactive substances’ means alcohol, opioids, cannabinoids, sedatives and hypnotics, cocaine, other psychostimulants, hallucinogens and volatile solvents, excluding coffee and tobacco;
7) «accident»: un événement lié à l'utilisation d'un ballon qui se produit entre le début du gonflage du ballon et le dégonflage complet du ballon, et au cours duquel:
a) une personne est mortellement ou grièvement blessée en raison de sa présence dans le ballon ou d'un contact direct avec une partie quelconque du ballon, y compris des parties qui s'en sont détachées, à l'exclusion des blessures dues à des causes naturelles, les blessures auto-infligées ou infligées par d'autres personnes;
b) le ballon subit des dommages ou une défaillance structurelle qui altèrent les caractéristiques de résistance, de performance ou de vol de sa structure et qui nécessitent une réparation importante ou le remplacement de l'élément endommagé; ou
c) le ballon disparaît ou est totalement inaccessible
7. ‘accident’ means an occurrence associated with the operation of a balloon which takes place between the moment of the commencement of the inflation of the balloon and the moment of complete deflation of the balloon, in which:
(a) a person suffers fatal or serious injuries as a result of being in the balloon or as a result of direct contact with any part of the balloon, including parts which have become detached from the balloon, but excluding any injuries arising from natural causes or which are self-inflicted or inflicted by other persons;
b) the balloon sustains damage or structural failure which adversely affects its structural strength, performance or flight characteristics and requires major repair or replacement of the affected component; or
(c) the balloon is missing or is completely inaccessible;
8) «incident»: un événement, autre qu'un accident, lié à l'utilisation d'un ballon qui compromet ou pourraitcompromettre la sécurité de son exploitation;
8. ‘incident’ means an occurrence, other than an accident, associated with the operation of a balloon which affects or could affect the safety of its operation;
9) «incident grave»: un événement lié à l'utilisation d'un ballon qui se produit entre le début du gonflage du ballon et le dégonflage complet du ballon, au cours duquel il existe une forte probabilité de survenance d'un accident;
9. ‘serious incident’ means an occurrence associated with the operation of the balloon which takes place between the moment of the commencement of the inflation of the balloon and the moment of complete deflation of the balloon, in which there was a high probability of an accident;
10) «phases critiques de vol»: le décollage, l'approche finale, l'approche interrompue, l'atterrissage et toute autre phase du vol que le pilote commandant de bord définit comme critique pour l'exploitation en toute sécurité du ballon;
10. ‘critical phases of flight’ means take-off, final approach, missed approach, landing and any other phases of a flight which the pilot-in-command determines as critical for the safe operation of the balloon;
11) «manuel de vol de l'aéronef (AFM)»: le document contenant les limitations opérationnelles applicables et approuvées ainsi que les informations relatives au ballon;
11. ‘aircraft flight manual (AFM)’ means the document containing the applicable and approved operating limitations and information with respect to the balloon;
12) «marchandises dangereuses»: des articles ou des substances de nature à présenter un danger pour la santé, la sécurité, les biens ou l'environnement et qui figurent sur la liste des marchandises dangereuses dans les instructions techniques ou qui doivent être classés comme tels conformément à ces instructions;
12. ‘dangerous goods’ means articles or substances which are capable of posing a risk to health, safety, property or the environment and which are shown in the list of dangerous goods in the technical instructions or which are to be classified as such in accordance with those instructions;
13) «instructions techniques»: la version applicable la plus récente des «Instructions techniques pour la sécurité du transport aérien des marchandises dangereuses», y compris le supplément et tout addendum, publiées par l'OACI dans le document 9284-AN/905;
13. ‘technical instructions’ means the latest applicable edition of the ‘Technical instructions for the safe transport of dangerous goods by air’, including the supplement and any addenda, published by ICAO in document 9284-AN/905;
14) «site d'exploitation»: un site choisi par le pilote commandant de bord ou l'exploitant, en vue d'opérations d'atterrissage, de décollage ou de chargement externe;
14. ‘operating site’ means a site selected by the pilot-in-command or the operator for landing, take-off or external load operations;
15) «avitaillement»: le remplissage des bouteilles ou des réservoirs de carburant à partir d'une source extérieureà l'exception du remplacement des bouteilles; L 71/14 FR Journal officiel de l'Union européenne 14.3.2018
15. ‘refuelling’ means the refilling of fuel cylinders or fuel tanks from an external source, excluding thereplacement of fuel cylinders;
16) «nuit»: la période comprise entre la fin du crépuscule civil et le début de l'aube civile. Le crépuscule civil se termine lorsque le centre du disque solaire se trouve à 6 degrés en dessous de l'horizon et l'aube civile commence lorsque le centre du disque solaire se trouve à 6 degrés en dessous de l'horizon;
16. ‘night’ means the period between the end of evening civil twilight and the beginning of morning civil twilight. Civil twilight ends in the evening when the centre of the sun's disc is 6 degrees below the horizon and begins in the morning when the centre of the sun's disc is 6 degrees below the horizon;
17) «exploitation de ballons spécialisée»: toute exploitation, commerciale ou non, d'un ballon dont le but principal n'est pas le transport de passagers pour des vols touristiques ou d'initiation, mais bien des opérations de parachutage, des lâchers de deltaplane, des manifestations aériennes, des vols de compétition ou d'autres activités spécialisées similaires;
17. ‘balloon specialised operation’ means any operation, which can be commercial or non-commercial, with a balloon the main purpose of which is not the carriage of passengers for sightseeing or experience flights, but parachute operations, hang-gliding dropping, flying displays, competition flights or similar specialised activities;
18) «charge marchande»: la masse totale des passagers, des bagages et des équipements spécialisés embarqués;
18. ‘traffic load’ means the total mass of passengers, baggage and carry-on specialist equipment;
19) «masse à vide du ballon»: la masse déterminée par la pesée du ballon avec tout son équipement tel que spécifié dans le manuel de vol;
19. ‘balloon empty mass’ means the mass determined by weighing the balloon with all the installed equipment as specified in the AFM;
20) «contrat de location avec équipage»: un contrat conclu entre exploitants aux termes duquel le ballon est exploité sous la responsabilité du loueur;
20. ‘wet lease agreement’ means an agreement between operators pursuant to which the balloon is operated under the responsibility of the lessor;
21) «exploitation commerciale de ballons pour le transport de passagers»: une forme d'opération de transport aérien commercial avec un ballon consistant à transporter des passagers à des fins touristiques ou à des fins d'initiation contre rémunération ou à tout autre titre onéreux;
21. ‘commercial passenger ballooning’ (CPB) means a form of commercial air transport operation with a balloon whereby passengers are carried on sightseeing or experience flights for remuneration or other valuable consideration;
22) «opération de transport aérien commercial (CAT)»: l'exploitation d'un aéronef en vue de transporter des passagers, du fret ou du courrier contre rémunération ou à tout autre titre onéreux.
22. ‘commercial air transport (CAT) operation’ means an aircraft operation to transport passengers, cargo or mail for remuneration or other valuable consideration.
