MINIMA FOR VISIBILITY AND DISTANCE FROM CLOUDS
Except when operating as a special VFR FLT, VFR FLTs shall be conducted so that the ACFT is flown in conditions of visibility and distance from clouds equal to or greater than those specified in the following table.

(*) The VMC minima in Class A airspace are included for guidance to pilots and do not imply acceptance of VFR FLTs in Class A airspace.

flight visibilities reduced to not less than 1500 m may be permitted for flights operating:
at speeds of 140 kt IAS or less to give adequate opportunity to observe other traffic or any obstacles in time to avoid collision; or in circumstances in which the probability of encounters with other traffic would normally be low, e.g. in areas of low volume traffic and for aerial work at low levels;
helicopters may be permitted to operate in less than 1500 m but not less than 800 m flight visibility, if manoeuvred at a speed that will give adequate opportunity to observe other traffic or any obstacles in time to avoid collision. Flight visibilities lower than 800 m may be permitted for special cases, such as medical flights, search and rescue operations and fire-fighting.
(**) In the Grand Duchy of Luxembourg
Flight visibilities of at least 1 500 m are permitted between 30 MIN before SR and 30 MIN after SS for FLTs operating either:
at 140 kt IAS or less that, in the prevailing visibility, will give adequate opportunity to observe other traffic or any obstacles in time to avoid collision
in circumstances in which the probability of encounters with other traffic would normally be low, e.g. in areas of low volume traffic and for aerial work at low levels.
Helicopters may be permitted to operate with a flight visibility of at least 800 m, if manoeuvred at a speed that will give adequate opportunity to observe other traffic or any obstacles in time to avoid collision.
Lighter-than-air ACFT are permitted to operate with a flight visibility of at least 800 m provided that they remain below 300 m (1 000 ft ) AGL.
2 VFR FLIGHTS IN CTR
Except when a special VFR CLR is obtained from an ATC unit, VFR FLTs shall neither take off nor land at an AD within a CTR, nor enter the AD traffic zone or AD traffic circuit when the reported meteorological conditions at that AD are below the following minima:
the ceiling is less than 450 m (1500 ft) or
the ground visibility is less than 5 km.
Special VFR flights may be authorized to operate within a CTR, subject to an ATC clearance. Except when permitted by the competent authority for helicopters in special cases such as medical flights, search and rescue operations and fire-fighting, the following additional conditions shall be applied:
by the pilot
clear of cloud and with the surface in sight;
the flight visibility is not less than 1500 m or, for helicopters, not less than 800 m;
at speed of 140 kt IAS or less to give adequate opportunity to observe other traffic and any obstacles in time to avoid a collision; and
by ATC
Clear of cloud and with the surface in sight
during day only, unless otherwise permitted by the competent authority;
the ground visibility is not less than 1500 m or, for helicopters, not less than 800 m;
the ceiling is not less than 180 m (600 ft).
Note: State aircraft are not submitted to these restrictions and have a permanent derogation.
3 VFR FLIGHT RESTRICTIONS
VFR FLTs shall not be operated:
at night
In Belgium: between 30 MIN after SSand 30 MINbefore SR, unless authorized by the Director General of the CAA or under the conditions described in 8.1.a below.
Note 1: The hours of apparent SR and SS at Uccle (see GEN 2.7 ) are taken into account for the calculation of these periods.
Note 2: State ACFT (MIL ACFT and ACFT used by State services such as police and customs) may fly VFR at night.
In the Grand Duchy of Luxembourg: between 30 MIN after SS and 30 MIN before SR, unless otherwise authorized by the Minister of Transport (see FLTs at night in the G.D. of Luxembourg).
above FL 195 unless authorized by the Director General of the CAA, in airspace reservation (TSA or its equivalent) and in accordance with specific arrangements agreed by the appropriate ATS authority;
at transonic and supersonic speeds.
4 VFR FLIGHTS OVER CONGESTED AREAS
Except when necessary for TKOF or LDG, or except by permission from the Director General of the CAA (Belgium), or from the Minister of Transport (in G.D. of Luxembourg).
a VFR FLT shall not be flown:
over the congested areas of cities, towns or settlements, industrial buildings, the L.N.G. Terminal of Zeebrugge, nuclear plants, prisons or over an open-air assembly of persons at a height less than 300 m (1000 ft) above the highest OBST within a radius of 600 m from the ACFT.
elsewhere, at a height less than 150 m (500 ft) above the ground or water, or 150 m (500 ft) above the highest obstacle within a radius of 150 m (500 ft) from the ACFT.
Note 1: In Belgium, the above does not apply to State ACFT.
Note 2: In the Grand Duchy of Luxembourg, these MNM height and distance shall never be less than 50 m (150 ft) for helicopters, ULM and lighter-than-air ACFT.
5 VFR CRUISING LEVELS
Except as specified below, VFR FLTs in level cruising flight when operated above 900 m (3 000 ft) from the ground or water, shall be conducted at a level appropriate to the MAG track as specified in the "Table of cruising levels" (see ENR 1.7).
Except if otherwise instructed in ATC CLRs or as indicated in the AIP, VFR FLTs operated in controlled airspace shall select cruising levels from those to be used by IFR FLTs as specified in the table of cruising levels.
6 COMPLIANCE WITH COMMISSION IMPLEMENTING REGULATION (EU) N° 923/2012
VFR FLTs shall comply with the provisions of Section 8 of IR (EU) No 923/2012:
when operated within Classes C and D airspace;
when forming part of AD traffic at controlled AD; or
when operated as special VFR FLTs.
8 SUPPLEMENTARY PROCEDURES
8.1 VFR flights at night
In Belgium
Gliders, DPM and ULM exempted, VFR FLTs at night are authorized under the following conditions:
if leaving the vicinity of an AD, a flight plan shall be submitted in accordance with ENR 1.10 regulations;
FLTs shall establish and maintain two-way radio communication on the appropriate ATS communication channel, when available;
the VMC visibility and distance from cloud minima as specified in table under ENR 1.2, §1 shall apply except that:
the ceiling shall not be less than 450 m (1500 ft);
the reduced flight visibility provisions specified in ENR 1.2 (**) (a) and (b) shall not apply;
at and below 900 m (3000 ft) AMSL or 300 m (1000 ft) AGL, whichever is the higher, the pilot shall maintain continuous sight of the surface;
for helicopters in airspace classes F and G at and below 900 m (3000 ft) AMSL or 300 m (1000 ft) AGL, whichever is the higher, flight visibility shall not be less than 3 km, provided that the pilot maintains continuous sight of the surface and if manoeuvred at a speed that will give adequate opportunity to observe other traffic or obstacles in time to avoid collision;
ceiling, visibility and distance from cloud minima lower than those specified in (3) may be permitted for helicopters in special cases, such as medical flights, search and rescue operations and fire-fighting;
except when necessary for take-off or landing, or except when specifically authorised by the competent authority, a VFR FLT at night shall be flown at a level which is not below the minimum flight altitude, or, where no such minimum flight altitude has been established at a level which is at least 300 m (1000 ft) above the highest obstacle located within 8 km of the estimated position of the ACFT (except for helicopters, the MNM level within the Belgian airspace for GAT operating between 2200 and 0459 should be as far as possible at or above FL 50).
Note 1: State ACFT may deviate from these rules.
Note 2: VFR FLTs at night within the AD traffic circuit are not authorized at EBBR.
In the Grand Duchy of Luxembourg
VFR FLTs at night may be operated in the airspace over the Luxembourg territory:
in the CTR
in the TMA up to FL 95 MAX
in Class G airspace up to 2 000 ft AMSL MAX.
